Terms of Service for Crowd Pet Health

1. Introduction

Welcome to Crowd Pet Health (the “Platform,” “Site,” or “Services”), operated by Crowd Pet Health (the “Company,” “we,” “us,” or “our”). Crowd Pet Health is an Alberta-based service. The Company may be a sole proprietorship or may be incorporated in the future.

Our Platform is a crowdfunding service designed to connect Members who seek financial support for their pet’s health expenses (such as veterinary treatments, surgeries, medications, and related care) with other Members who wish to provide support through pledges.

All users of the Platform are referred to as “Members.” Members may act as “Requesters” (creating crowdfunding requests for their pet’s health needs) or as “Pledgers” (making pledges to support other Members’ requests), or both.

The Platform allows Members to create crowdfunding requests, which are subject to our approval process, including verification by contacting the veterinarian to confirm the legitimacy of any veterinary bills or related expenses. Once approved, other Members may make pledges on the Platform to support the request.

Importantly, we do not take possession of any funds, process payments, hold donations, or act as a payment intermediary. Pledges are recorded on the Platform as commitments, but actual payment (if any) is arranged and sent directly by the Pledger to the Requester using methods agreed upon between them outside the Platform (e.g., e-transfer, direct bank transfer, or other peer-to-peer methods). We are not a payment processor and bear no responsibility for any pledges made, payments sent, payments received, payments not completed, or any disputes arising from direct transfers.

By accessing or using the Platform, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

We may update these Terms from time to time. We will post material changes on the Platform and update the “Effective Date” above. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use the Services. You must provide accurate information, comply with all applicable laws (including Canadian laws on fraud, consumer protection, animal welfare, and donations), and reside in a region where the Services are available.

3. User Accounts

Registration requires truthful and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend, block, or cancel any account at any time, for any reason, without notice or liability.

4. Crowdfunding Requests (Requesters)

As a Requester (who is also a Member), you may submit a crowdfunding request for pet health funding. All requests are subject to the following minimum requirements:

  • The verified veterinary invoice must be for a completed treatment or service with a total amount of at least $350 CAD (this minimum amount may be adjusted by us at any time without prior notice).
  • The Requester must personally cover a minimum of $100 CAD of the total invoice value themselves (this minimum contribution amount may be adjusted by us at any time without prior notice).
  • The crowdfunding goal displayed on the Platform will be automatically reduced by $100 CAD (or the Requester’s actual contribution if higher) to reflect only the amount being requested from the community.

All requests must:

  • Provide accurate, truthful descriptions of the pet’s health condition, required treatments, costs, and intended use of any funds received.
  • Include supporting documentation (e.g., a completed veterinary invoice clearly showing the total amount and breakdown; we do not accept estimates or quotes).
  • Be submitted for our review and approval, which may include us contacting the veterinarian directly to verify the invoice or related details.

We reserve the right to approve, reject, or remove any request at our sole discretion, including if it does not meet the minimum invoice amount, personal contribution requirement, or if only an estimate (rather than a completed invoice) is provided. Approved requests are displayed on the Platform for other Members to view and pledge support.

You must post updates on the request’s progress and treatment outcomes. You are solely responsible for handling any funds received directly from Pledgers, complying with tax laws (donations are generally not tax-deductible unless qualifying under CRA rules), and using funds only for the described pet health purposes.

5. Pledges (Pledgers/Members)

As a Pledger (who is also a Member), you may view approved crowdfunding requests and make a pledge on the Platform to indicate your commitment to support a Requester.

Pledges are voluntary and recorded on the Platform but do not constitute payment. We do not facilitate, process, hold, guarantee, or enforce payment of any pledge. If you choose to fulfill your pledge, you must send the pledged amount directly to the Requester using a mutually agreed method outside the Platform.

We are not responsible or liable for:

  • Whether a pledge is fulfilled or paid.
  • Any payments sent, received, or not completed.
  • Disputes, non-delivery of funds, misuse of funds by Requesters, or any issues arising from direct peer-to-peer transfers.
  • The accuracy or legitimacy of any request (beyond our vet verification process, which is limited in scope).

Pledges are non-refundable except as may be agreed directly between you and the Requester or required by applicable law.

Excessive or repeated instances of creating too many crowdfunding requests or making too many pledges that are reported as not paid/fulfilled may result in account suspension, blocking, or cancellation at our sole discretion. This includes patterns of behavior that appear abusive, misleading, or disruptive to the Platform community.

6. Member and Business Owner Rating System

We maintain a Member and Business Owner Rating System to promote trust, transparency, and positive community behavior. This system applies to all Members (including Requesters, Pledgers, and business owners/listings) and is separate from any Points, Rewards, or Crowd Dollars.

  • Ratings start at 100 points.
  • Points can decrease to 0 or increase up to 150.
  • Higher or lower points unlock different badges displayed next to your name/profile (e.g., trust indicators, warnings, or achievement badges).
  • The rating system currently evaluates factors such as:
    • Fulfillment of pledges (as reported by Requesters or verified through community reports).
    • Posting multiple crowdfunding requests without pledging donations or using other methods to gain rating points.
    • Repeated reports of unfulfilled pledges.
    • Other behaviors deemed disruptive or untrustworthy.
  • Deductions may occur for the actions listed above.
  • We may adjust points at our sole discretion based on verified reports or Platform monitoring.
  • Ratings are visible to other Members to help inform decisions about pledging or interacting.
  • You may not manipulate, dispute ratings falsely, or encourage others to do so—violations may lead to further point deductions or account actions.
  • Additional factors such as quality and legitimacy of crowdfunding requests, community feedback, reviews, reported behavior, and compliance with Community Guidelines and these Terms may be incorporated into the rating system in the future. We reserve the right to add, modify, or remove rating factors at any time, without prior notice.

This system is designed to encourage responsible use and is not a formal credit score or legally binding assessment.

7. Points, Rewards, and Crowd Dollars

Any Points, Rewards, or “Crowd Dollars” earned through Platform activity have no cash value, are non-transferable, and may be revoked, modified, or terminated at our sole discretion at any time without notice or compensation.

We are not liable for loss of such items due to glitches, hacks, errors, account termination, or otherwise. No reimbursement or recovery is available.

Note: These are separate from the Member and Business Owner Rating System described above.

8. Fees

Membership fees, advertising fees, business listing fees, or other paid features are non-refundable and auto-renew unless properly canceled.

No refunds will be issued if your account is suspended, canceled, blocked, or terminated for any reason.

9. Community Guidelines and Prohibited Conduct

You agree not to:

  • Post graphic images or videos of pet surgeries, death, severe injury, abuse, or other distressing content. Exception: Non-graphic images or videos of rescue animals may be posted in our designated Rescue section of the community, provided they do not depict death, overly graphic injuries, surgeries, abuse, or other highly distressing elements.
  • Use vulgar, profane, obscene, or offensive language.
  • Post spam, unsolicited promotions, sales, or advertising unless expressly authorized by us.
  • Submit fake, fraudulent, or misleading requests (including fabricated health issues or documents).

Violations may result in immediate account suspension, blocking, or cancellation without notice. Fake or fraudulent requests may be reported to law enforcement for potential fraud charges.

We may remove content or restrict access at any time without notice.

10. Business Directory & Advertising

Business listings and advertising require approval. Fees are non-refundable.

We may remove any listing or advertisement at any time, for any reason, without notice or refund.

Reviews will not be edited or removed except for proven fraudulent submissions (at our sole discretion).

Business owners are also subject to the Member and Business Owner Rating System.

11. Intellectual Property

All Platform content is owned by us or our licensors. You grant us a non-exclusive, royalty-free license to use, display, and distribute content you upload for operating the Services.

12. Disclaimer of Warranties and Limitation of Liability

Services are provided “as is” without warranties. We do not guarantee request approval, pledge fulfillment, fund receipt, vet verification accuracy, rating accuracy, or Platform error-free operation.

To the fullest extent permitted by law (including under Alberta’s Consumer Protection Act), we disclaim all liability for direct, indirect, incidental, consequential, or punitive damages, including from failed pledges, disputes, fund issues, or rating-related claims. Our total liability is limited to amounts you paid us in the prior 6 months or CAD $100, whichever is less.

We are not responsible for direct transactions between Members or third-party actions.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Services, violations of these Terms, your content, or direct pledge-related activities.

14. Termination

We may suspend, block, or terminate access or accounts at any time, for any reason, without notice or liability.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and applicable federal Canadian laws. Disputes shall be resolved exclusively in the courts located in the County of Barrhead, Alberta.

16. Miscellaneous

  • If any provision is unenforceable, the remainder remains in effect.
  • No waiver unless in writing.
  • These Terms, along with any linked policies (e.g., Privacy Policy, Community Guidelines), form the entire agreement.
